TraceMate Search Terms of Service

Welcome to TraceMate! These Terms of Service (“Terms”) govern your use of the TraceMate mobile application (“App”) provided by Beta Apps LLC (“we”, “us”, “our”). By downloading, installing, or using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Use of the App

Eligibility: You must be at least 13 years old to use the App. If you are under 18, you may only use the App with the consent of a parent or guardian.

License: We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Prohibited Activities: You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Interfere with or disrupt the App or servers or networks connected to the App.
• Reverse engineer, decompile, or disassemble any part of the App.
• Violate any applicable laws or regulations.

2. In-App Purchases

General: The App offers certain features and content for purchase (“In-App Purchases”). In-App Purchases are available for a fee, as specified within the App.

Payment: Payment for In-App Purchases will be processed through the platform (Apple App Store or Google Play Store) from which you downloaded the App. By making an In-App Purchase, you agree to the terms and conditions of the respective platform.

No Refunds: All In-App Purchases are final and non-refundable, except as required by applicable law or the platform’s refund policy.

Subscription: If the App offers subscription services, your subscription will automatically renew unless canceled at least 24 hours before the end of the current subscription period. You can manage and cancel your subscription through your account settings on the respective platform.

3. User Content

Responsibility: You are solely responsible for any content you upload, post, or share through the App (“User Content”).

License: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content in connection with the operation of the App.

Prohibited Content: You agree not to upload, post, or share any User Content that:

• Is illegal, offensive, or infringes on the rights of others.
• Violates any applicable laws or regulations.
• Contains viruses or other harmful components.

4. Privacy

Data Collection: We collect and use your information as described in our Privacy Policy, which is incorporated by reference into these Terms.

Third-Party Services: The App may integrate with third-party services, and your use of such services is subject to their respective terms and privacy policies.

5. Intellectual Property

Ownership: All intellectual property rights in the App and its content are owned by us or our licensors. You do not acquire any ownership rights by using the App.

Trademarks: TraceMate and Beta Apps LLC are our trademarks. You may not use these trademarks without our prior written consent.

6. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, expenses, and costs (including legal fees) arising out of your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Arizona, without regard to its conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms within the App or through other means. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.

Apple App Store Specific Terms

Subscriptions and Auto-Renewal: If you purchase a subscription, Apple will charge your Apple ID account at confirmation of purchase. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current subscription period. You can manage and cancel your subscriptions in your account settings on the App Store after purchase.

Refunds: Refunds are provided at the discretion of Apple and are subject to Apple’s refund policy. Please refer to Apple’s support for more information.

Google Play Store Specific Terms
